Is it the beginning of the end for Article 35A from ‘State Funded Institute’ in J&K?

The Jammu & Kashmir Institute of Management, Public Administration and Rural Development (IMPA), an autonomous body under the agies of State Government, invited application on all India basis from the eligible candidates for the posts of Professors, Assistant Professors and Associate Professors. Though Article 35A makes any non-permanent resident of the state ineligible for any government job under the state government of Jammu and Kashmir but the applications are sought by the Regional Centre of IMPA at Jammu from suitable candidates across India. This institute is also funded by the Ministry of Rural Development. The recruitment rules of IMPA were changed during 1992, when terrorism was at its peak and the then Central Government made Jagmohan, who is believed to have changed the recruitment rules in IMPA during his tenure, as the Governor of the state. These changed rules were never tinkered with by any subsequent governments and it allowed the Institute to seek application on an all India basis.
 

 
The Director Training Mushtaq Ahmed Khan said that IMPA is also funded by National Institute of Rural Development and keeping in view the new recruitment rules, non-state subjects can get jobs. There are apprehensions that the present recruitment process may weaken the controversial Article 35A. This constitutional provision debars the non permanent members to apply for any of the jobs under the state government and a petition challenging the validity of provision is pending before the Supreme Court, who will hear the matter next year.
