No! Stone-Pelters and Pellet injured aren’t real victims, lets know about the abandoned victims of J&K

 
 
 
Whenever human rights violation in Jammu and Kashmir (J&K) is discussed, it arise the pictures of only stone-pelters, people injured from pellet guns and separatists in our minds. As if they are combating the battle for claiming their human rights and rest of the people across entire state of J&K are living a prosperous life. Though we do not claim that the stone-pelters and people injured from pellet gun are not the victims but there are people in J&K who have been discriminated by the central and state governments and their plight have not been heard since independence. Whether it is insertion of unconstitutional provision (i.e. 35A) or the willful ignorance of successive state and central government; the national and international media and human rights organizations, these people are almost invisible from the perception of victims in J&K though their victimization has been institutionalized in J&K. Their plight has been obscured to the extend that neither academic discourses nor the champions of human rights would mention about them. The political parties who have been based on the vote of these victims in India do not dare to utter a single word about their plight in J&K.
 
 
Today, Human Rights Day is observed by the international community to reminiscent 1948 when United Nations General Assembly adopted the Universal Declaration of Human Right. India is also celebrating this important day and taking pledge to uphold them in its entirety but this day is also used as an opportune time for certain political brass to target their opponents. Like any other smart politicians, who are harping on the violation of human right in J&K the National Conference President Farooq Abdullah stressed on peace and sustainable development as two essentials for upholding Human Rights and blamed the previous PDP-BJP government of J&K for ignoring these two. He said right to education, right to assembly, right to profess any religion and above all right to live a dignified life are the basic human rights for every man. The focus of his words is not for entire J&K but like any other valley based political party, he referred only to Kashmir.
 
 
 
 
 
Ironically, large chunks of victims in J&K, who having been waging their peaceful battle for attaining their basic human rights for the last many decades, have not been included in the focus of NC president. They are the victims, who have either been persecuted by Pakistanis mercenaries or terrorists or state government or the central government. These victims can be categorized into three major categories viz. Victims of Article 35A, POJK displaced person and terror affected people. These categories are further divided into different sub-categories:
 
 
1. Victims of Article 35A: Article 35A was inserted in the constitution of India, without presenting and passing it from the Parliament, through a presidential order in 1954. By adding this provision in the constitution the president violated Article 368 of the constitution that gives power only to the parliament to add or delete any provision from the constitution. He also violated Article 60 of the constitution that binds the president of the country to protect, preserve and defend the constitution of the country. This unconstitutional provision has sanctioned the practice of institutionalized discrimination against the spirit of the constitution of India. There are four major categories of victims of this provision and these victims are:

3. Terror Affected People:
 
 
 
It is essential that these victims must be recognized and their human rights must be restored. The Kashmir valley based political parties and national government must take a leaf from the Human Right Day and take some concrete steps to resort their rights.
